Terms of Use

Website kunstikoda.ee

This translation is provided for convenience. In case of discrepancy, the Estonian version prevails.

1. General

1.1.These terms of use (the “Terms”) govern the use of the website kunstikoda.ee (the “Website”). The Website is owned and operated by Vlaesto OÜ, registry code 11785091, address Väike-Sõjamäe tn 3e, Lasnamäe linnaosa, 11415 Tallinn, Harju County, Estonia (“Kunstikoda”).

1.2.By using the Website the user (the “User”) confirms that they have read and accept these Terms.

1.3.In addition to these Terms, participation in auctions is governed by the Auction Terms, purchases from the online shop and shipment of works by the Sale and Delivery Terms, and the processing of personal data by the Privacy Policy. In case of conflict, the specific terms of the service concerned prevail.

1.4.In these Terms, Consumer means a natural person using the Website for purposes outside their trade, business or profession.

2. User account

2.1.Some services on the Website, including bidding at auction, require a user account.

2.2.The User shall provide accurate and complete information on registration and keep it up to date.

2.3.The User shall keep their password and username secure and notify Kunstikoda without delay of any loss or unauthorised use.

2.4.Actions taken from an account are deemed to have been taken by the account holder. Kunstikoda is under no obligation to further verify the identity of the person logging in.

2.5.Each person may hold one user account.

2.6.Kunstikoda may suspend or close an account and refuse new registration where the User has breached these Terms or other Website terms, supplied inaccurate information or failed to meet a payment obligation owed to Kunstikoda.

2.7.The User may request closure of their account at any time by writing to Kunstikoda’s e-mail address. Closure does not release the User from obligations already incurred.

3. User obligations

3.1.The User shall not use the Website for unlawful transactions, fraud or in any manner contrary to good practice.

3.2.The User shall not compile lists or databases of Website users.

3.3.The User shall not use automated means (robots, scripts, scraping tools) to copy Website content in bulk, including catalogue and price data, or to place bids, except for the automatic bidding function offered on the Website.

3.4.The User shall not disrupt the operation of the Website or attempt to gain unauthorised access to its systems.

3.5.A User who is not a Consumer shall compensate Kunstikoda for any loss caused by the User’s breach of these Terms. A Consumer is liable to the extent provided by law.

4. Online shop, information and prices

4.1.The works displayed on the Website are unique objects, each available in a single example, and may be offered simultaneously through other channels.

4.2.Descriptions of works are based on the information known to Kunstikoda. Photographs are illustrative; colours, tones and paper texture may differ from the original depending on the screen and lighting. A deviation in dimensions of up to 1 cm is not a defect.

4.3.Prices are in euros and include VAT where applicable. Shipping costs are displayed before the order is placed.

4.4.A contract of sale is concluded when Kunstikoda confirms the order by e-mail. Kunstikoda may cancel an order before or upon confirmation where the work is no longer available, where it has been displayed at a manifestly incorrect price owing to a technical error, or where payment is not received within three business days. In that case any sum paid is refunded in full; other claims are excluded.

4.5.Kunstikoda may change prices and its selection of works. A change of price does not affect orders already confirmed.

4.6.Works entered as lots in a forthcoming auction cannot be purchased from the online shop while that auction is running.

4.7.A Consumer may withdraw from a contract for a work purchased from the online shop within 14 days of receiving the work. The direct cost of return is borne by the Consumer. Details are set out in the Sale and Delivery Terms.

4.8.Art-historical information, sale prices and auction results published on the Website are for information only. They are not an expert valuation of any work nor investment advice.

5. Intellectual property

5.1.The content of the Website – texts, art-historical descriptions, catalogue and price data, photographs and design – is protected by copyright and database rights and belongs to Kunstikoda or is used with the rights holder’s permission.

5.2.Copying, republication or commercial use of the content without Kunstikoda’s written consent is not permitted. Linking to the Website with attribution is permitted.

5.3.Copyright in the works of art depicted on the Website belongs to their authors or successors in title. Acquiring the physical example of a work does not transfer copyright to the Buyer.

5.4.A rights holder who considers that content on the Website infringes their rights is asked to notify info@kunstikoda.ee. Kunstikoda will review the notice and, where justified, remove the content without delay.

6. Liability

6.1.Kunstikoda makes reasonable efforts to ensure that the information on the Website is accurate and current, but does not warrant uninterrupted or error-free operation. The Website may be temporarily unavailable owing to maintenance or technical failure.

6.2.Kunstikoda is not responsible for the content of external links or for the operation of third-party services (payment, courier, hosting).

6.3.Kunstikoda is not liable for loss arising from the User’s breach of these Terms or failures of the User’s equipment or connection, nor for non-performance caused by force majeure.

6.4.Kunstikoda’s liability in connection with a purchase is limited to the price of the work. Kunstikoda is not liable to a User who is not a Consumer for indirect loss or loss of profit.

6.5.The limitations of liability do not apply in cases of intent or gross negligence, death or personal injury, or to the extent that the law does not permit liability to be limited.

7. Marketing communications

7.1.Kunstikoda may send the User information about forthcoming auctions, catalogues and new works where the User has consented, or send a customer whose e-mail address it obtained in connection with a purchase information about similar works to the extent permitted by law.

7.2.The User may opt out at any time via the link at the foot of each message or by writing to Kunstikoda’s e-mail address.

7.3.Messages directly related to an auction or purchase (invoices, payment confirmations, handover information) are not marketing communications and are sent regardless of consent.

8. Notices

8.1.Kunstikoda sends notices to the e-mail address stated in the User’s account. An e-mail is deemed received on the business day following its dispatch.

9. Amendments and validity

9.1.Kunstikoda may amend these Terms by publishing a new version on the Website. Registered Users are notified of material changes by e-mail.

9.2.Amendments take effect on publication unless a later date is stated in the new version. Transactions already concluded are governed by the version in force at the time of the transaction.

9.3.These Terms are in force from 1 October 2026 to 30 September 2027. If no new version has been published by then, these Terms remain in force until a new version is published.

9.4.If any provision of these Terms is held invalid, the validity of the remaining provisions is not affected.

10. Governing law and disputes

10.1.These Terms are governed by the law of the Republic of Estonia. For a Consumer, this choice of law does not deprive them of the protection afforded by the mandatory provisions of the law of their country of habitual residence.

10.2.Disputes are settled primarily by negotiation. Failing agreement, disputes with a business are resolved by Harju County Court, and disputes with a Consumer by the court having jurisdiction under the law.

10.3.A Consumer may apply to the Consumer Disputes Committee operating at the Consumer Protection and Technical Regulatory Authority (Endla 10a, 10122 Tallinn, www.ttja.ee).
